These Terms and Conditions of Sale govern the relationship between MANOA and any person making a booking with Atelier MANOA.

2. Scope

Atelier MANOA offers, among other services, hands-on pastry workshops, workshops for individuals and children, private and corporate workshops and events, team-building activities, and the sale of pastries, sweet products, drinks and gift cards.

These Terms and Conditions of Sale apply to bookings made online and to services booked directly with Atelier MANOA.

All bookings imply full acceptance of these Terms and Conditions of Sale.

3. Workshop bookings

Workshops require an advance booking. Bookings are made directly on the Atelier MANOA website.

The customer selects the desired workshop, date and time, number of participants and, where applicable, the chosen creation or cake.

A booking is confirmed once payment has been validated. A confirmation email is sent to the customer upon completion of the booking.

The customer is responsible for the accuracy of the information provided when making the booking.

4. Prices and payment

Workshop prices are displayed on the Atelier MANOA website in euros, inclusive of all taxes.

Payment for the booking is made online when the order is placed.

Atelier MANOA reserves the right to change its prices. However, the applicable price is the price displayed when the booking is confirmed.

5. Cancellation by the customer

The customer may request cancellation of their booking up to 72 hours before the workshop starts.

In this case, the customer may choose between a refund of their booking or a credit note for the amount of the booking.

The cancellation request must be made to Atelier MANOA in accordance with the procedure stated on the website or in the confirmation email.

Cancellations made less than 72 hours before the workshop starts are not eligible for a refund or a credit note.

6. Transferring a booking

If the customer is no longer able to attend the workshop, they may transfer their booking to another person.

The replacement participant must attend the same workshop, on the same date and at the same time.

The cake or creation selected when the booking was made cannot be changed when a booking is transferred.

The transfer does not entitle the original customer to any refund or credit note.

7. Changing the booking date

A booking cannot be moved to another date at the customer’s request.

If the customer is unable to attend, they may transfer their booking to another person under the conditions set out in section 6.

8. Late arrival

Workshops start at the time stated when the booking is made.

If a participant arrives late, the workshop cannot be delayed to allow them to take part in the full scheduled programme.

A late participant may join the workshop where this is compatible with its progress and safety requirements.

Late arrival does not entitle the customer to a refund, a credit note or a rescheduled booking.

Depending on the length of the delay and the stage the workshop has reached, Atelier MANOA may refuse to admit the customer if their arrival is likely to disrupt the workshop or compromise safety.

9. Cancellation or changes by Atelier MANOA

Atelier MANOA may exceptionally need to cancel or change a workshop, particularly in the event of a technical problem, a safety issue, exceptional unavailability, an administrative closure or force majeure.

If Atelier MANOA cancels a workshop, the customer will receive a full refund or be offered an alternative time slot, at their choice.

If no alternative date is suitable for the customer, a full refund will be issued.

10. Right of withdrawal

Under Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure activities provided on a specific date or during a specific period.

Bookings for Atelier MANOA workshops on a specific date and at a specific time are therefore excluded from the statutory right of withdrawal.

The cancellation conditions set out in section 5 of these Terms and Conditions of Sale apply.

11. Participants’ ages

Workshops are open to participants aged 12 and over attending on their own, and to children aged 6 and over when accompanied by an adult.

For children aged 6 to 11 inclusive, the accompanying adult must remain present throughout the workshop.

The accompanying adult is responsible for the child in their care and must ensure that the child behaves appropriately and follows the instructions given by the Atelier MANOA team.

The accompanying adult does not take part in a workshop themselves and may not carry out the preparation or handling activities reserved for the participant, unless Atelier MANOA expressly provides otherwise.

12. Food allergies and intolerances

Atelier MANOA workshops may use ingredients that are among the main food allergens, including gluten, eggs, milk and dairy products, tree nuts, peanuts and soya.

The customer must disclose any known allergy, intolerance or dietary restriction before the workshop.

Atelier MANOA will make every effort to take the information provided into account and adapt certain preparations where technically possible.

However, food is prepared in an environment where various allergens are handled. Atelier MANOA therefore cannot guarantee the complete absence of traces or cross-contamination.

In the event of a severe allergy or a significant risk to a participant’s health, Atelier MANOA may, for safety reasons, advise against or refuse their participation in certain preparations.

13. Workshop procedures and safety instructions

Participants agree to follow the instructions given by the Atelier MANOA team and the hygiene and safety rules applicable on the premises.

The equipment provided must be used in accordance with the team’s instructions.

Any dangerous or aggressive behaviour, or behaviour likely to seriously disrupt the workshop, may result in the participant being excluded without a refund.

Children remain the responsibility of their accompanying adult in accordance with section 11.

14. Cakes made during the workshop

At the end of the workshop, each participant takes home the pastry they have made.

Creations are intended to be taken away and are not consumed on the premises.

The customer is responsible for transporting and storing their creation once it has been handed to them.

Atelier MANOA recommends following any storage instructions provided at the time of departure.

15. Gift cards

Atelier MANOA offers gift cards valid for 12 months from the date of purchase.

A gift card may be used during its validity period, across multiple transactions and up to its available balance. It cannot be exchanged for cash and is non-refundable.

A gift card cannot be extended beyond its expiry date, unless Atelier MANOA exceptionally agrees otherwise.

If a gift card is lost or stolen, Atelier MANOA cannot be held liable for its fraudulent use.

16. Photography and video

As part of its activities, Atelier MANOA may take photographs and videos of workshops, creations and the general atmosphere of the venue to communicate about its activities and promote Atelier MANOA, including on its website and social media.

Atelier MANOA will ensure that the necessary permission is obtained where participants are identifiable.

For participants who are minors, permission must be given by their legal representative.

Refusing to be photographed or filmed does not prevent participation in a workshop.

17. Liability

Atelier MANOA takes the necessary measures to ensure participants’ safety and the smooth running of workshops.

Participants must follow the instructions given by the team.

Atelier MANOA cannot be held liable for damage resulting from a participant’s failure to follow safety instructions or from their behaviour.

Participants remain responsible for their personal belongings. Atelier MANOA cannot be held liable for the loss, theft or damage of personal belongings left unattended on its premises, unless this results from a fault directly attributable to Atelier MANOA.

18. Force majeure

Atelier MANOA cannot be held liable for a failure or delay in performing its obligations where this results from an event of force majeure within the meaning of French legislation and case law.

In such circumstances, Atelier MANOA will inform the affected customers as soon as possible and, where possible, offer a postponement or refund depending on the circumstances.

19. Personal data

The information collected when a booking is made is necessary to process the order, manage the booking and maintain the customer relationship.

Personal data is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

The customer has, in particular, the rights of access, rectification, erasure and restriction of processing, and, under the conditions provided by law, the rights to object and to data portability.

For any request relating to personal data: [GDPR contact email to be completed]

A detailed privacy policy is available on the Atelier MANOA website.

20. Intellectual property

All elements on the Atelier MANOA website, including text, photographs, illustrations, logos, trademarks, recipes presented, graphics and content, are protected by intellectual property law.

Any reproduction, public display, modification or use, in whole or in part, without MANOA’s prior authorisation is prohibited.

21. Complaints

Any complaint must be sent to Atelier MANOA as soon as possible at: contact@ateliermanoa.fr.

Atelier MANOA will endeavour to find an amicable solution to any difficulty arising in the performance of a service.

22. Consumer mediation

In accordance with the French Consumer Code, a consumer may refer a dispute, free of charge, to the consumer mediator responsible for Atelier MANOA after first sending a written complaint to Atelier MANOA and receiving no satisfactory response, or no response within the applicable statutory period.

23. Governing law

These Terms and Conditions of Sale are governed by French law.

In the event of a dispute with a consumer, the applicable statutory rules on territorial jurisdiction apply.

24. Acceptance of the Terms and Conditions of Sale

By confirming a booking, the customer acknowledges that they have read these Terms and Conditions of Sale and accepts them without reservation.
